Welcome to The Kelly Lab Photography (“we,” “us,” or “our”). By booking our services, using our website, or engaging with our work in any capacity, you agree to the following Terms of Service. Please read them carefully.

1. Services & Booking

1.1 Booking Confirmation

  • A non-refundable retainer is required to secure your booking. The remaining balance is due [1 days] before the session/event.

  • Bookings are confirmed only after the retainer has been received and a contract is signed.

1.2 Cancellation & Rescheduling

  • Retainers are non-refundable but may be transferred to a future date if rescheduling is requested at least [2 days] before the session.

  • Cancellations made within [48 hours] of the scheduled session will result in forfeiture of all payments made.

1.3 Force Majeure

  • If unforeseen circumstances (such as illness, natural disasters, or emergencies) prevent us from providing the agreed-upon services, we will work with you to reschedule or provide a suitable replacement photographer.

2. Photo Delivery & Usage

2.1 Turnaround Time

  • Edited digital images will be delivered within [Please refer to yor contract] from the session/event date unless otherwise stated. Rush editing is available for an additional fee.

2.2 Image Rights & Copyright

  • The Kelly Lab Photography retains full copyright over all images.

  • Clients receive a personal-use license, allowing them to print and share the photos for non-commercial purposes.

  • Commercial use (for business promotion, marketing, or resale) requires a separate licensing agreement.

2.3 Editing & Retouching

  • All delivered images are professionally edited. Additional retouching requests beyond standard editing may incur extra fees.

  • RAW or unedited files are not available for purchase or distribution.

3. Client Responsibilities

  • Clients are responsible for arriving on time to sessions.

  • Locations requiring permits, entrance fees, or other special arrangements must be disclosed in advance and covered by the client.

  • We are not responsible for wardrobe malfunctions, weather conditions, or uncontrollable factors affecting the session.

    Force Majeure & Data Loss

    We are not liable for service disruptions due to unforeseen events, including natural disasters, technical failures, or emergencies. In the rare case of catastrophic data loss, we will attempt recovery, offer a full refund if no images are retrievable, or provide a reshoot when possible.

4. Liability & Refunds

  • Our liability is limited to the amount paid for the service. We are not responsible for lost or damaged images due to unforeseen circumstances (technical failure, data loss, etc.).

  • Refunds are only provided in extreme cases where we are unable to deliver the agreed-upon service.

5. Privacy & Data Protection

  • Client information is kept confidential and used only for booking, invoicing, and communication purposes.

  • We may showcase select images for portfolio, website, and social media marketing. If you wish to keep your session private, please notify us in writing before the session.

6. Modifications & Governing Law

  • We reserve the right to update these Terms at any time.

  • These Terms are governed by the laws of [TEXAS], and any disputes will be resolved accordingly.
